If you do live trap mice, please be sure to check the traps several times a day and release the mice promptly, approximately a mile away from your home. It is much more cruel to allow a mouse in a live trap to slowly starve to death than to kill it quickly with a snap trap. Also, if you use the live traps outside, put a little bedding (paper towels or cotton balls) inside the trap so the mice won't freeze to death during the night. When you release the mice, do it in an area with some sheltering bushes or plants. If you are a kind person, you might also leave a little bird seed or oatmeal for them.
The absolute cruelest traps are glue traps. Mice have been known to gnaw off their own limbs and tear off their skin in an effort to escape, as they starve or dehydrate to death or suffocate in the glue. Poison isn't any better, as the mice die slowly over a long period of time from internal bleeding.

Put a little hunk of chocolate on a glue trap. They are kind of cruel but I've had smart mice like that who won't go the easy way of instant death in a regular trap! If he's too smart for the glue traps try baiting him first. Put out seeds (They LOVE grass seed), chocolate or some kind of food without a trap in the same spot for a week or so then sneak in the trap after he's comfortable being fed everyday.

Try what I've used. I caught five of them, and let them go in the woods.

No more mice.
And, they aren't very smart. They love sunflower seeds.
Put a few of them in the trap, and watch them pile in.
Also, the trap needs a little winding to keep the door opening quickly.
They look so funny inside, big wide eyes, and they had different colors too. Most were dark brown, one was big and reddish.
All gone now, but I keep my traps around.

If by really smart you mean it's getting the food out without setting off the trap, I had that problem too and solved it by putting peanut butter with a bit of peanut under the bait bale, and jamming it in there with a toothpick then breaking off the toothpick. That makes the mouse have to tug at the peanut. Worked here.

I'd vote for getting a cat. Of course, cats are only rated for 1500 square feet, so you'll have to figure out how many cats you'll need based on how big your house is.
If that is unappealing to you, I'd go with the triangular shaped bait stations. You put them in a corner with poisoned bait and the mice go in and eat and then run off and die. You can pick this up in a garden center someplace like that for under 10 bucks. I wouldn't go to an exterminator though. That's what we did and paid about $160.00 for the same thing!

This may not work for you, but it is a funny story. We had a mouse that was impossible to catch. My canister vacuum was sitting upright, with the hose hole up top. Quite accidently it fell into the hole, and we were able to take it far away to release. Next time I have a similar problem, I will not rely on chance, just put something yummy in the vacuum cleaner. !!

I dont know if we just had a greedy mouse or what but my grandmother once used a little piece of raw bacon.. I know it sounds crazy I even told her it would'nt work!! I guess that's why shes the grandma and I'm the grandchild because it did. If that dosent work for you use a small piece of sticky good candy that you would wanna eat make it good for him it will be his last meal anyway once you try my method!!

Try a larger snap trap or multiple traps at spots you know the mouse travels and try solid bacon fat - got rid of all my mouse probs in one night - caught 7 and that was that.

a very crude method.
set traps of carboards with mouse glue at every possible entrance into the rooms and openings. leave no openings or space for it to jump over. store all food in a solid closet. remember to lay the glue trap at the door of the food closet, too. then wait for the mouse to get caught in a sticky situation!

Put poison on the trap, that way if it takes the bait without setting the trap it will die from the poison.
But if you don't want to have a stinky corpse somewhere hidden in your house try a sticky trap or get a cat.
