Technically, it's not even not rape: it's not theft either. You can't make a valid contract offering an illegal service, and prostitution is illegal in most western nations (or at least in practice if not in name). The prostitute would have no recourse whatsoever.

No it is not rape, it is a crime, a service was rendered for which there was a contract, even though it might have been verbal, there was a contract and if the individual did not pay, then he should be subject to punishment just like all other thieves.

Well, look at it like this:
If the prostitute agreed to let the guy have sex with her, then SHE decided by her own will to have it with him. So, its not rape.
And since the guy doesn't pay her, it would use be using her for her own 'goods', and also breaking that 'rule' of pay/money trust between the guy and her.

She consents to the sex as a condition of payment. If the condition of payment isn't met then the sex wasn't consentual so it is rape and theft.
