To be safe, it would be best not to take action greater than necessary to protect yourself, your family, and your property, and to take into consideration the age and maybe the mental capacity of the person or persons who broke in.

You didn't mention whether or not you'd be home at the time. It matters.
If you're not home - there's zero% probability that they are threatening your safety - so if your German Shepard eats them, you're guilty of manslaughter!
On the other side of the coin, if someone threatens your life - and you're at THEIR house - you can defend in court your need to kill them.
The fact is though, you don't ever want to have to kill someone. For home protection, get a pump action shotgun. If you hear someone break in, yell "I've got a gun!!" and pump one round into the chamber. This scenario will probably be in the dead of night (no pun intended), so it will be silent. The burglar will recognize that sound and leave before the two of you see each other. Or get a loud yappy dog. Burglars don't want to be found out. A loud barking dog could bring attention to him, and he'll leave.
Way better than having to defend the decision to take a life - and having to live with that decision for the rest of yours.

Im not sure on that, i know that in some places if you have no trespassing signs on your property and they still come on your property then you are allowed to take action, but if it is to severe you could get in big trouble, unelss they are threating your life.

It think it must be legal in America since it was what George bush was preaching. Breaking into some one country and executing them.

Yes, but if you use a fire arm, make sure it is registered. Secondly if the person has a weapon and displays it, you definitely have a right to self-defense.
