I sold my brother my car in July for $1,750. We made a contract stating he would pay $250 on the 20th of every month and the ramaining balancing on the last month. He has only paid me $850 and has stopped paying me. He owes me for Nov. and Dec. and he is avoiding me. The only problem is I stated that I sold it to him for $1 so the registration would be lower with DMV.

If you have any proof that you really did sell the car to him for 1750.00 I would go after him. What kind of a brother does that? Or if you don't want to waste the time or energy, then just eat the money and learn to never give him another penny!!!

You should be able to enforce it in court, but you've complicated things lying to DMV, so I'm not sure how that works and would only matter if he brings it up to the judge.

Just learn from this it's never a good idea to get involved in major purchases with your family. Or friends for that matter.

If you do take him to court, have the contract with you. I'm sure you both signed it. The DMV thing might be a problem.

I think the correct question should be, "Is my relationship with my brother worth more than a measly $900?"
I would forget it, take the loss and NOT help him out again. If he has a soul, he'll feel like sh*t and eventually pay you back.

if you have a written contract, it should be enforceable by a court. however, you may face a fine of some sort for lying to the DMV...

Sue him the court will not pay any attention to the DMV!!

If you want your money, you can either try to convince him to pay voluntarily or take him to court. Then again, what impact will that have on your relationship with him?
