It is Columbia House DVD club that did this. They sent me a card telling me my featured selection and I didn't respond by the deadline and normally they send me the bill for it and if I don't want the DVD they send it back. This time they took it off my debit card and I didn't even receive the movie. I made the mistake by paying a previous bill by debit card so now they have my number on file. I went to the store today thinking I had plenty of money on my card and to my surprise I didn't because of the DVD club. Just wondering if it legal.

Contact them and tell them U never got the selection they said they sent and ask them credit the money back to your acct.

If they say they sent it out ... ask them to give you proof.

In any case, call the Atty Gen office in your city, explain the situation and ask them what you should do to get a refund and to cancel your acct with them (if U want it cancelled).

Yes it's legal. If you look into their agreement you will find terminology reflecting that they may charge whatever they have on file. I would immediately terminate your contract with them or cancel your debit card. Do not EVER give a company the ability to auto deduct from a debit card. It's like having a joint owner on your account.

Also....do NOT call the police. This is not a criminal offense. It is a civil situation and we can't do anything about it.

Columbia house does this a lot even with credit cards. They only way to stop this recurring charge is tell your bank you lost the card. Telling the bank it compromised will not stop Columbia house from finding out the new card number and they have their ways. A Customer Service rep told me to prevent a recurring charge you must tell the bank you lost the card even if it is a lie.

Before you contact the police or an attorney, you better go through the fine print on the agreement you agreed to when you joined the club. I am willing to bet that it is in there somewhere that they can, and will, do just that in instances like yours. It is probably in the Terms and Conditions section that most people tend to overlook.

Companies are good at that, so I am willing to bet that what they did was in compliance with their policies that you either agreed to or gave implied consent to by joining the club.

Yes, they have been doing this for years. I call it assumed consent selling. They know that a large portion of the people will not send it back in. That is the catch.

My guess is there was wording in your member agreement that allowed them to do it. If so, then yes it is legal. Thats the problem with those clubs.
