any legal problems and what would i have to do to get the rights to a certain name??

Go to your public library. Ask where is the department of copyrights. They will give you all of the materials you need to copyright your name. Fill them out. Mail them and you will find out if there is a problem.
If you are using your last name, just go to the records building, and take out a DBA. It is only about $20.

First check with your States Secretary of State, Corporation Commission. To really be safe, you should do that for every state. Next best, Check with the U.S. Copyright office for name copyrights and trade names. No guarantees though. Hussong and Larry's Mexican restaurant in Vancouver WA was sued by Hussong's Cantina in Ensenada Mexico, so they changed their name to Who-Song and Larry's.. Never a dull moment.

go to city hall, check their records. even iff someone has the name you want, if is isnt legally protected under trademark and recorded at city hall, then they cannot file lawsuit. another tricky way to safeguard your name is using the format "Restaurant" by owners name. its distinguishing and the visitor assumes you have multiple restaurants across the country.

Check a registry of ficticious business names in your area. You'll have to register your business name as well. When you do that, you'll be flagged if there's a duplicate.
