As long as it has enough charge in the battery to get a signal it will work.

Yes it's the law. Even payphones have to do this. If you have a cell phone that is off and has been off for a number of years it must be able to dial 911. that is hopefully the cellular network can still utilize the phones technology.

Yes, in the United States it's the law. (as long as the phone isn't so old that the technology it uses is no longer in use)
