No in most states only parents (step parents included) have any rights to punish a child like this unless BOTH parents consent.

Sorry I am not 100 percent about the laws in New York State, but the father could call child services and report this to them, they would know for sure and let him know what could be done about it.

There are 49 other states where that is not alright.I don't care if it is an ex girlfriend a ex boyfriend ex husband or ex wife or the present one hell no no one should ever spank a child for any reason.I have raised 5 children 11 grand children and have 3 great grand children that have never been spanked,Oh yes they were brats at times but they all love and respect me and everyone the come in contact with comment on how well they mind and what good kids they are.

If the child is living in the Ex-Wife's & her new boyfriend's home, the boyfriend can do any damn thing he pleases and the Father of this child has nothing to say about it.

The ONLY recourse is that IF the child is being abused, such as red marks, bruises, sprained or broken bones, the Father must call the police and DEMAND an inceident report immediately! THEN file a motion for modification of custody IMMEDIATELY!

IF the boyfriend has abused your child, make damn sure that he AND THE MOTHER gets prosecuted for child abuse. MAKE SURE HE AND THE MOTHER GETS PROSECUTED FOR CHILD ABUSE... Do I need to repeat that again?

Other than that, ALL states will lament that it is a CIVIL issue and you need to hire a lawyer and take it back into court.

Best bet is to hire a PARALEGAL! THEY are the backbone to and much cheaper than a lawyer. Besides, MOST lawyers only show up in court to make an appearance that they are there for YOUR BEST INTERESTS! NOT! Read the lawyer's OATH OF OFFICE and you will see that YOU are third choice AFTER their being an OFFICER OF THE COURTS first and foremost. YOU are just a paycheck to them.

No way anywhere in the US is the ok. A parent can use spanking as a reprimand only if used within reasonable force. Anyone outside a parent touches their child with or without parental permission can be charged with assault and/or child abuse. The parent who lets this happen can also be charged as an accessory with the same charges and will most certainly lose her custody rights. Contact the local authorities if you have evidence this is happening.

The father can call child services and depending on the severity of the spanking the children could be removed from the home.

It is not alright for a boyfriend or even an ex-wife's husband to physically discipline the children (only if he legally adopted them). I know because this came up on Judge Judy and she was a NY family court judge.

NO! unfortunately when a child deserves a spanking the only one allowed to spank is the biological parent.

the boyfriend actually has NO rights, and as far as I know, stepdad's don't really have any legal rights either. If Dad says no and he's being ignored, he needs to take some legal steps to make sure his wishes are being followed.
