Well if they are endangered, then it's illegal.

It's also illegal if someone is keeping it as a pet.

Aside from that, I'm not sure if it is a crime. If it is, though, it probably varies by jurisdiction. It's also probably not something that you would ever be charged with -- if you have bats in your basement, kill them, and throw them out, it would be very unlikely that anyone would come after you. It's just too much of a waste of time.

It would be best to find out through your state's Parks and Wildlife Department(or whatever it is in your state). Some animals are obviously protected as they are on the endangered species list. Some are protected for other reasons.

Example: In Texas, though they are not endangered, Buzzards are one of the most protected birds in the state. Reason: They are responsible for cleaning about 70% of the road kill off of rural roads, saving the state a great deal of money.

Check with your local agency in charge of Parks and Wildlife, and they should have an online list of protected animals, and why.

If an animal is endangered or otherwise on a protected status, killing them is illegal and is considered poaching. You either need a license (such as for fishing or deer hunting) or you can't hunt them at all (like the Bald Eagle)

You need to check with the DNR in your area to know what, if any, pests you can kill on your own.

I didn't know either but I guess fruit bats got on the endangered list so all the enviro wackos pressured the legislature to pass laws.

I have not heard that before (that does not mean it is not true).
Thanks for the heads up, if I have to kill a bat now, I will make sure that I leave no evidence behind that will link that murder to ME! I would suggest that you do the same. Last thing we need is 'robin' knocking on our door or 'alfred' calling us from gotham city trying to have us arrested!

Bats eat more insects than almost any other animal on earth, so if you kill a bat you just saved thousands of disease carrying mosquitos.

Only if it is on the endangered species list is it against the law. Otherwise there is no law against it.

In Wisconsin it is. We had our basement infested with them and the DNR said all we could do would be to get an exterminater in because we weren't allow to poison them or take other means. They would have to be removed. We found out put a tub of water where we thought they were comming in cured us of them.
