Email the first buyer and tell them that you have already sold the item, and you're sorry it's no longer available. Tell them you tried to get in touch with them to find out about payment options, and never received a response, so you had no choice but to sell the item to someone else. Just apologize you don't have the item, since you never received any communication from them, and try to end the issue on a decent note.
That's happened to me a few times, and I found that if I just make it look like I'm sorry that I don't have the item anymore, they are usually understanding and don't leave negative feedback. Make sure you point out that the blame lies with them for not contacting or responding to you, but then apologize like it's your fault for not having the item.
Civility is the best way to prevent any negative feelings. I'm sure they know how long it's been, and they shouldn't have any problem finding a similar item on eBay. Plus, they should be happy they didn't receive negative feedback from you for wasting your time.

Refund the money to the first non paying bidder. Ebay states that a buyer only has so many days to contact or pay for the item.

If I were dealing with this, I think I would just send the item to the 2nd buyer.
There is a reasonable amount of time when you can expect your money, and I think you went way past that.
When dealing in Ebay, there is a certain amount of risk in dealing with people and this is another example of the aggravations a seller has to deal with occasionally.
Refund the first buyer's money.
Send the mdse to the second buyer.

If you didn't state in your auction the period of time the buyer has to pay, then they really did nothing wrong. But I too sell on ebay and don't say in my auctions the buyer has an amount of time to pay....it just goes without saying :o) I would refund the first persons money and sell to new bidder. I've been selling for nine years and that's my opinion. If they didn't have the money to pay for it then they shouldn't have bid!

Refund the original buyer because they should have paid within a two week limit and now its been a month. You also filed a no pay claim so, I think they had their chance and they didn't communicate with you.

sell it to the new person. a month is way to long to make a payment. it already has been reported to eBay that they didn't pay so nothing would be held against you. the 1st buyer will probably leave retaliatory feedback though but you have the proof you did what you was supposed to do.
