My husband has custody of his daughter, she went to er mom's for christmas. She was to fly back yesterday, her mom did not put her on the plane, and now will not answer our calls, what legal action can we take?

you need to call the police in the town she lives in, then you will have to fax them a copy of the visitation schedule..Also, you need to have your husband get back into court and possibly have her visitation pulled. If she is not following the agreement write it all down, dates and times and have him get into court.

Maybe there was a family emergency on her end. She should have called if she was able to.


If the mother has been trustworthy up 'til now don't you think it would jumping the gun a bit by getting the police and lawyers involved, atleast until your husband finds out why. She may have had an accident.

If she has always given your husband problems with visitation then he needs to contact his attorney.

What is your husbands thoughts on all of this?

Note to other posters:
She cannot legally do anything. She is the stepmother. The father has to be the one to deal with the legal aspects of custody issues

hello,
well first you need to find the custody papers and find out what they say so you have proof of where your daughter is suppose to be with you...then file a kid napping charge against her mother for not abiding by the court order...it is parental kidnapping when a parent will not surrender the child...she can get in alot of trouble for not following court orders....and you have to do it in both states that you and her mother live in.....so it can be a long process to get her back in your custody.....and some courts say that she is the other parent and won't do any thing so i really hope you the best of luck and i hope you get your daughter back.....and if the child is any where between 11-14 there really isn't any thing you can do because she can tell them she wants to stay with her mother and the state will grant it because her voice can be heard by the courts...so best of luck to you

Unless there is a good reason, the child's mother is in legal trouble for kidnapping. Talk with your lawyer and inform the police where she lives.

Call the police and have the court papers ready The Mother is breaking a court order.She can go to jail for what she has done.

Then you take her to court or she can go to jail. I would call your lawyer and then call the police. If you have a divorce decree stating that he has legal custody then that's that. She has to abide by it or she can go to jail.
