I had a new patio cover installed on my screen room. It has leaked four times already (with every rain). The company has been out three times already to attempt to repair it with no avail. It is leaking bad. It floods the floor of my room and I have lost some stuff that I had to throw out from getting wet. Also, the compnay split my fascia upon installing and put caulking all over my brand new roof. Since, they can't fix it, I did not know if I should call my insurance company to file a claim because I obviously need a new cover. I just paid $4800 for this one a little under three months ago. I have photos and was planning on sending a certified letter to the company demanding they fix it this time or I will contact the BBB and take legal action. I am just worried that this will make them mad and they won't come out to fix it.

If your insurance covers water damage..... then you can file... I think I would go after the company that installed it.. They are the ones at fault you know

However, it also depends on your insurance. Some policies have gaping holes in them (such as insurance on flood damage is not included in 99% of all Homeowners policies). Have a conversation with your agent about your policy and what you can claim. As for the discarded stuff, you *may* be able to include that if you are covered, but it is, unfortunately, unlikely.

As for Legal options...consult with a lawyer, right away. Many law firms will allow an initial consult for free. It will also give you the advantage of having a legal opinion to base your decisions on.

Contact your local Tv station. Most stations have a "Problem Solver" Segment. Very few if any businesses want their name spread out over the news in a negative way. If nothing else it might get you your money back. The stations around here do follow-ups to make sure the agreement of any kind are followed thru on.

Make your case first, don't tell them what your up to In the mean time keep contact make sure they're still around with cordial calls. Not sure about that part sounds sneaky,but you have to protect your interest and make sure they don't split Call your states atty ask her what to do.: ) And mad smad They never finished the job you (Payed) them for Too bad you didn't cancel the check before hand,they might of had it done. hay, filing an insurance claim will surely raise your premiums. and may not get the repair done to your satisfaction. you said you have photos, save them, get another contractor or even two to give you an estimate on currant damage to structure,inc. floor ,walls, ceilings, trim, siding, and any other damage to your structure. get the estimates in writing. make copies/save at least 1 for use by you later then send copies to people who did the work. if you use another contractor go his $ vs.what was paid to get previous work done plus any personal losses(furniture, etc.) tell old contractor they will be reimbursing all monies unless they return and complete work to your satisfaction. including court cost and your lost time;)good luck. my guess is that they will bend over backwards to get it done

The contractor needs to file the insurance claim,without satisfaction very soon,I would contact an attorney !
