i was made redundant from work but my employer was still liable for paying my SMP. however they have now sold the business and will be disappearing over the horizon by the time my baby is born. will they still be responsible for paying me, the new business owners or will i be able to claim Maternity Allowance then?

UK by the way so what you do in america wont be any use, thanks anyway

It really depends on the contract the new owners had when they took the business over. did they buy just the stock or all the debts as well? You need to get clarification. If they took over all the debts then they are liable to pay you, if not then the previous owners have to pay you. You should go to local citezens advice to see what to do next. The new owners should be liable for any responsibilities as the old owners. However it is probably in your best interest to consult a lawyer and have them draft a letter to your new employer advising them of their responsibility.

If a lawyer is too expensive or you want to try something less confrontational first. Try asking for a meeting with the new owners and the old owners (or anyone who knows what the old owners were going to do, such as accounting or HR). And just say that you are concerned about what is going to happen and need to know now so you can plan accordingly.

If your employer doesn't pay then I think you could claim maternity allowance, as long as you could demonstrate that you had tried to claim it from your previous employer.

You and your partner are going to be responsible for your materity pay. Your employer didnt make you pregnant right?
