Although registration of land is now compulsory when it is sold, this hasn’t always been the case. This means many properties across England & Wales are still unregistered. Less than 60 per cent of England and Wales is currently registered, but more and more people are choosing to register their landholdings with the Land Registry.

Although registration is not compulsory until land is sold or mortgaged, making a voluntary application brings many advantages. Having your land registered with Land Registry provides a guarantee of land ownership. You can rest assured that your title has the very best protection. It is the most effective way to bring all your documentation up to date and allows easy access to details online.

Common land is not land which is commonly owned. The term ‘common’ refers to the ‘rights of common’ that local people (known as ‘commoners’) were granted in the middle ages.

Rights of common vary depending on the land, but may include grazing animals and collecting firewood. Some properties lie on common land, and thus are open to encampment from travellers.

However there is a myth that land that is unregistered or abandoned is also unowned - this is untrue. All land is owned by someone and if you claim land by squatting on it, there is no guarantee that the true owner will not use the law to reclaim it. Registering the land however speeds up the removal of squatters on the land. If the owner of the caravan owns the land, it is not a problem, however, if the owner of the land is a buch of travelers, then the site being used by mutiple families may have implications to do with services and impact on neighbouring settlements.

A squatter may only acquire title to registered land by application to the registrar ..
