Lance Corporal Smith is now in U.S. military custody and he will remain so until the completion of the judicial proceedings. The Philippines bowed to pressure from Washington over custody of him....this came after the US canceled military exercises with the Philippines next year because of the issue.

Daniel Smith is just another American casualty on the war on terrorism. From the start of this case even unscrupulous filipino politicians joined the frenzie for political gain. Besides, who knows if that Nicole is not connected to the Abbu Sayaf, the NPA or National People's Army or other subversive groups. If you are in the Philippines as an american, don't trust anybody. I am surprised to see how some filipinos hate americans. They even celebrated when the planes hit the 2 buildings in NY on 9/11. That's my advice to all of you out there because I live there and I know.

Smith is better off in the US embassy where he's currently locked up. After all, incarceration = isolation/quarantine not torture in crowded Philippine prisons.
I also believe that this is not an act of "favorable treatment". It's just that the US is more able to take responsibility for an offender's well-being [even].
It isn't right that because Filipino criminals endure great sufferings in their one-degree-better-than-hell cells, then Smith, or every offender for that matter, ought to share the same fate with them.

If he's guilty then he's supposed to serve time in the country where the crime was committed.

This is a similar case to one that happened in Japan in 1995.
