If your name is on the lease you have a legal requirement to ensure that the rent is paid as per your contract.
Can't you kick him out? Or organise a flat mate for him?

Nope it's not okay for you to stop paying half of the rent, as an adult you are on the lease and until your name comes off the lease you are still liable for your half of the rent whether you're living there or not. I suggest you have a talk with your landlord at LEAST 30 days prior to moving out or you could also wind up having to pay the landlord ALL of the rent if your husband gets evicted because he can't pay the rent completely. When/if your husband gets evicted the landlord will have to recoup the cost of the time he wasn't paying the rent as well as costs in rental loss because he could have been collecting full rent from another tennant.

For legal reasons, no. You're not moving out immediately, and if he fails to pay all the rent, you might wind up in a lawsuit from the landlord. Pay your half until February to prevent any fights or a possible suit from the landlord.

If he has enough money to buy alcohol now then maybe he should slow down a little and put the alcohol money toward February's rent. It's really his problem, not yours.

If the shoe was on the other foot would you be cool with him not helping you. In this life most of the time we try to play God by getting even and getting back at each other. Revenge is not ours. Even alcoholics can redeem themselves. Who knows in a couple of years he could clean himself up and you become interested. Are you going to want him to give you a second chance? Pay the rent, especially if its not going to affect your pockets.

If your name is on the lease then you are responsible for the rent. As responsible as he is. For the full amount. Address the issue in court. Make sure it is part of the divorce decree. Any debt in the decree you can show your papers to the creditors and show them it is no longer your responsibility. But without a judges signature if your name is on it you have to pay for it.

You should pay your share of the rent so long as you live there. Once you move, your moral obligation (but not necessarily your legal obligation -- depends on the lease) ends.

Did you also sign the lease agreement? If you did, they you can be bound by law to pay your half until the terms of the lease are up. If you didn't sign the lease, then you are free to go without paying a dime. Good luck.

He has money to support his drinking and he can figure out a way to come up with the money to support a roof over his head.
