i heard there is a law that if my sons father stops paying support for a year that i can file abandonment and my soon to be husband can adopt him. i was just wondering if anybody knows anything about this.

this man doesn't take care of my son, his mother does(who i have no prob with) he cannot hold down a job and he is a very bad influence. we live in oklahoma so i'm not sure of the laws on that. Just this week his grandmother brought him back early from visitation b/c she pulled a muscle in her back and his father wouldn't take off work, yet i did! He also let him get severly dehydrated at one point before taking him to the doctor.

Gosh, how horrible. The child shouldn't have to suffer without his biological dad over money.

Sure. He does not care for the child's well being, so why should they visit. Lot's of Dads will go away quietly and stop asking for visitation when they stop paying.
The moral of the story...know a person very well before you let him father (or give birth to) your child.

You would have to check the child support/custody laws in your state. Frankly I've never heard of such law. A parent has to SIGN away their parental rights before someone else can adopt them.

It depends on the state you live in. But even if he is not paying child support (if you two have gone to court and he has been told to pay) and he is not seeing the child or having any contact it is probably possible. But it is very hard to prove someone an unfit parent

Are you heavily this stupid? How does terminating your RIGHTS influence your familiar jobs? Your criminal duty to pay newborn help is a duty, no longer a eye-catching. Your question is like asking: If I provide up eating apples, am i able to give up paying hire?

you cant keep a dad from seeing his child because he hasn't paid child support..... seeing his child / and paying child support are separate issues.... now as far as stating abandonment for a dad not seeing his child for a year I'm not sure about that... but I'm only going by Georgia Law...

A father does not lose his rights over his child, just because he does not pay support. (ive seen too many losers get away with not paying and they still have rights to see their kids)

He has no right to see his son then...as careless as he is. When he is caught , through court, he will have to pay irregardless! It will all add up to him being a dead beat dad!
