I have lived in the big city up north before. Been there, done it seen it. Hafta drive fast, make fast decicions, rat race. Slick streets? Hafta say other person was at fault cause they rear ended you. Unless you were a dumb @ss and just pulled out without looking. I always adjusted the way I drive in the winter and slowed WAY down. good luck!

Sorry to say, but you are at majority fault. The idea here is that the car that hit you was travelling a straight path in an proper lane of traffic. Technically, you are not considered to be in a travel lane if you are pulling off of the curb, driveway, or the like. If it was not for you, the car could have continued without incident. Since you interfered with their path, you become at fault.

No one here can know what will happen, only guess at the outcome. I would say, from the description you gave, that you were at least partially at fault - you say you did not see the 'cycle rider, which is a too common occurrence among many drivers, and that fact will be used against you. In the future, do a double check of all mirrors (the inside and both side view ones) before even considering a lane change, and get some "spot" mirrors on the outside side view mirrors - the eliminate any blind spots on the side and the rear of vehicles

Usually any hit from behind would be "their" fault but this one seems to be to be a both-fault or no-fault accident. I've been in accidents on slippery streets where the cop fell down trying to investigate and no one was blamed because no one could have stopped in those conditions.

If you got hit while changing lanes, you are at fault. You must make sure you have clearance to make a lane change.

If you were hit straight-on the rear bumper, it should almost always be the other person's fault. Was a police report filed? These usually indicate fault. Was anyone cited in the accident?

when you are hit from behind its 100% the other guy unless they can prove that you were interfering with the flow of traffic or violating some traffic signal or law.
