If "the marriage has not been consummated owing to the incapacity of either party or to the wilful refusal of the respondent to consummate it. Medical evidence is required to prove incapacity." then an annulment can be provided in the UK.
However after 3 and 1/2 years it would be almost impossible to prove. You may just want to get a divorce.

I agree with Andy and ABRC. If you are the wife in this situation, then it might be easier to apply for a divorce than try and get the marriage annulled. Horrible situation and most unusual.

The other answers are mostly right. It can be annulled if not consumated. However, that would require one of the partners to apply for an annulment on those grounds. After all, nobody else would know!

It is legal but as mentioned previously can be annulled, though I think this may have a 1 year limit on it. Get legal advice.

NO - it is definitely not - u can apply for an annulment - through the church even, and also through the courts, and you arent even classed as 'married' as soon as any unnaulment takes place - you are classed as never having been married to this person - as the marriage was not consumated

It is still legal but it can be anulled which is different to divorce. It is one of the only times that even the church agrees with separation.

Its not considered legal at all, and if anyone wanted to make a fuss about it they could. This is called marriage fraud.
