First of all, it's January 23rd, not January 1st.
Secondly, this requirement is (for now) only for those trying to enter the US by plane. Crossing the border at a land crossing will stay the same for at least another year.
Thirdly, there is no 'punishment' per say. That would be only if a crime were committed. It is not illegal, and will not be illegal for a US citizen to return home with or without a passport, now or in the forseeable future. Even after the new law takes effect, crossing without all the proper documentation will be only a civil matter unless you try "entry without inspection" which is a crime (ie crossing at an unmanned and non-designated place.) Even EWI would be very unlikely to be prosecuted, but it COULD be. In any event, worst case you would just subject yourself to some inconvenience. If crossing by land, even that is a year away.

The punishment will be that you are sent to stupid school.
If a passport is required then a passport is required-why try to cross without one-it will only create problems for you to get into the U.S.

If you can provide some form of evidence that you might be a US citizen, you will be held at passport control until your citizenship is verified and proven. However, this is at the discretion of the border guard. If you cannot prove right of entry into the US, you will not be allowed into the country and returned on the earliest possible flight back to Mexico.
