wife and me are not officially separated yet, but are in process of working out parenting plan and asset splitup arrangements.

Understand that during this phase abandonment could constitute one parent leaving the other with the kids and leaving for the night, which is exactly what happened. She took off, said she was going out, never said where. 4 yr old Daughter was sick that night, couldnt reach wife, cell phone off and no idea where she was. Comes back at 3 am.

Found out later she met her 'lover' at a sleazy motel that night. Have proof, but she doesnt know this yet.

Does this qualify as abandonment or not?

It doesn't qualify as abandonment, but it could help you keep your daughter. Get a lawyer so that you know your rights.

The term abandonment has a multitude of uses. But leaving child even sick for the night with the father in charge is definitively abandonment and even not negligence her part. She is definitively not a good wife and caring mother if she new that child is very sick.

No. In order to qualify for abandonment she would have had to disappeared for a "lengthy" period of time with neither contact nor support.

In my state, the spouse has to be absent for a few years. You have to have made an effort to find him/her and have no idea where he/she is.
