I have my house rented to a builder who was going to use the house for his workers. He never paid owes 6 months of rent and is not paying. Can I put a mechanics lien on one of his houses he is building?

No, you have to evict him and then sue in small claims.

You can only put a lien on his house if you provided services on the house itself.

No, a mechanics lien is used by someone who has performed work a property.

Also, there is time limits for which you can apply for a mechanics lien (in my area, you have 90 days from the completion of the job).

Your best bet would be to get a judgment against the builder and then file to execute the judgment (which will trigger a Sheriff's Sale of his assets to satisfy the judgment).

Do you have a signed rental agreement with him? If so, then take him to court. A verbal agreement is also binding, but much harder to enforce or prove.

Anyone can put a lien on someone's property, even if it's for $10, but you better be sure you have the documentation. If you have a signed agreement, take him to court. (You can only put a lien on property he or his business owns. Be sure the property you are targeting actually belongs to this guy.)
