If your state recognizes gay marriage, it is the same as the law. If you live with someone over a short period of time , in some states that is considered community property. I had a GF and she lived in Texas with a man and they were going bust up. She still had to get a divorce in order if he agreed to not count what they had accumulated during this time as community property, even though she bought the home with her money after they started living together. He was nice enough to let her have her house but he could have gotten half in Texas.

you don't get extra bonus points because you were in a violent relatioship...

If you were married, the only relevance violence would have is that you would have extra things to place in the divorce petition.

You have a right to maintenance for your son and a right to your share of the property once sold. That's it. NO, you don't get the house.

If the relationship is violent in the UK....Call the police they will remove him for you. Then seek legal advice. Don't put yourself at risk hunni. But seek advice wherever you are in the world there will be helplines for people in abusive relationships. Just going to a lawyer may not be enough...especially if mail from them lands on the doorstep for your partner to find.....Take care hunni.....Your safety is paramount....Property is property at the end of the day. x

Usually one or the other will have to buy the other parnter's share in the house or it needs to be sold and the equity split 50/50, unless he signs his share over in leui of maintenance. Would have been more helpful to you had your son been younger, but that's life, unfortuately, because local Councils are not overly helpful unless young children are involved.

it all depends on the legal things you put in place to protect yourself. you can specify that in the event of him being unfaithful, he has to move out and still pay his part for a number of years (say 10) until you make arrangements to be able to pay it all.

you need to go to a lawyer with him and sit and discuss all the possible contingencies- put nothing past any individual- love and life gives you no guarantees, add that to the volitile human factor and you've got a bomb that will explode under the right (or wrong) circumstances.

if he really is in it for the long haul he will be willing to sign almost anything. my fiance and i agreed that the unfaithful party will leave paying for 10 yrs their share. that's a lot of money to play the *** with and is a big deterrent to being unfaithful.

When I divorced I was told one or the other had to buy out their half of the house if jointly owned but luckily my ex signed the house over to me.(I ended up losing it to foreclosure) I would talk to a lawyer to know your legal rights for you and your son. Good Luck to you both.

yeah u can have the house utill he's 18 then u have to sell and split the money.
Don't leave until u have sorted this out with a solicitor and i hope it does't get to messy for u good luck

Get a good lawyer. Take your equity from the house and find a safe place somewhere else to live.

Once violence is part of someones life it never leaves. For you and your sons sanity, find a solution.

you could get him out -and have the house until your son, is 18yrs old. Then the house will have to be sold.Just have an airtight case against him with the violence.
