Back in June my boyfriend and I signed a one year lease on a house. We are both applicants on the lease. In October we split up and he called our landlord. The landlord has now given me a sixty day notice to move and says that he rented to us as a couple and since we broke up this null and voids our lease. I am still apying my half of the bills including rent and have done nothing to break my lease that i know of. I wish to move yet housing in my area is hard to come by and intill I find a new home why should i have to move. Room-mates with the ex is hard enough but being homeless, well thats not right , is it?

No where in the lease does it stipulate any condition based on us being a "couple". My landlord only rents this house and no others. I have been paying my own bills from the start and have cancelled checks as proof.

Your landlord is a bit of an idiot. As long as you have not violated any of the conditions of the lease, then your lease is still in force. Take this notice to the city hall or local housing authority to figure out what steps you should take to avoid any trouble from this guy. I bet that if you wanted out of the lease, he would hold you to it. You rented the apt. as roommates and your exact relationship means nothing as long as both names are on the lease.

Being a Assistant Property Manager, this situation seems a bit bizarre to me. When a couple who is not married rents a apartment/house, they are both liable for the rent. To make sure this happends, the landlord should have income qualified each of you and not you two as a whole. The only reason the landlord should be kicking you out is if you can't pay all of the rent. That is it. Did you sign a professional lease? If so, ask you're landlord if you can se where in the document it shows that if you two were to break up the lease is voided. Sounds like to me you should call fair housing and have this investigated by proper officials. You have more rights than you think. TRUST ME!!!

However, if this is a house that is owned by the individual, and is renting 4 or less homes all together, he files under a different classification that the typical apartment/home that is rented.

Check into the picture as a whole and not just you're situation. Good Luck

You are joint tenants and as long as the rent is paid you cant be evicted based on familal status. There might have been something said or requested in that phone call that has the landlord thinking he can do this. A 60 day vacate notice is odd and while he can refuse to renew the lease there seems to be no lawful justification for an early break. Good luck with the ex and the emotional turmoil that can be.

If the lease does not specify you must live there as a couple I don't see how the landlord can force you to move.

As long as you pay the rent and don't break any of the conditions of the lease he really can't do much.

If necessary see a lawyer or Legal Aid to get your rights protected.
