You can return it - its faulty, you are entitled to a full refund (Sale of goods act 1979).
The only reason shops say that is so they do not have to refund you. With gamestation it is a bit more complicated as most of their items are vid games - but the law still applies.
And don't let them fob you off with store credit under the sale of goods act you can get a full refund.
Ensure you take the origional packaging & receipt.

i had the same problem but i stated i opened it to discover that it would not work, they rang a few people but i stated i cant pay for something tat was broken it isn't my fault.
if all else fails make a big thing about it shops hate that. or check it out with trading standards if they don't agree. that's the problem with Xmas they mass produce loads of stuff so i don't think we get good quality.
i remember as a kid always one of my toys were broke, it was always the best one too.
take it back, if they grumble you grumble some more..Good luck!

RING THE STORE FIRST , explain your situation and then take it back ,ask for the person you spoke to on the phone , ( no one else) . this worked for me since christmas , be polite and it will get you a lot further . dont forget to get the person's name on the phone ,or they'll be looking at you as if you have two head's . I had no receipt and they will say it is not the policy of the store , but if your genuine they will see that .good luck .

Reading what is in your question, yes.
The fact that it's opened doesn't affect your statutory rights - the toy should have lasted more than 3 or 4 days.
Of course, I'm assuming that you didn't break it by dropping it, or using it to bang a nail in the wall!

Why not? It is defective...say what you just did and demand a replacement. Report to BBB in your area if you do not get satisfaction.
