my sister worked for a chevron gas station in fl and in august she had a customer leave her wallet in the store when she came in on second shift. a second shift cashier put the wallet in a brown paper bag and placed it behind the register. several people on second shift were seen on video rummaging through the wallet as if looking for I.d. or a contact number. when 3rd shift came in they were told by 2nd shift what had happened. my sister who was the manager came in on 1st shift and was greeted at the door by the customer. the customer xplained what happened and my sister started looking for the wallet. she searched and could not find anything. she advised the customer to come in later after she speaks to all employees. after the lady left my sister and her asistant searched everywhere and found nothing. the lady came back in that night and spoke with a girl on second shift who told the lady that she gave the brown bag containing the wallet to the manager. the lady came in again

the next day and spoke with my sister and told her someone had said that she had the wallet. my sister insisted that she had never seen the wallet. my sister then went into her office and viewed the camera footage from the night in question and you could clearly see 2nd and 3rd shift going through the wallet. the DM came in and told my sister that because of several problems she had been having in the store he was requiring her to come in for several hours on ALL shifts. my sister said there was no way she was coming in to work on every shift or put in 70 hours a week while only getting paid for 40. the girl on 2nd shift quit abruptly the following day and 2 weeks later my sister put in her notice verbally and written. in november my sister started a new job at the courthouse as a clerk and last week was pulled into her supervisors office and told if she was aware she had charges pending against her. she knew nothing and was told that she had petit larceny charges pending and because

of that and her still being on 90 days probation she was being let go. she was fired and told that she had a probable cause affidavit filed against her by(and they stated the lady's name). the lady who left her wallet is accusing my sister of taking the wallet because the 2nd shift girl told her that she handed my sister the wallet in a brown paper bag. my sister has proof that she was not working that night by paperwork and video and she has proof by testimony of another employee who was there when the lady came in that they both did not see or find anything behind the camera. her court date is jan 6 and she has a lawyer. can she sue the lady for defamation of character because it did directly cause my sister to loose her job on allegations that clearly are false and can she fight to get her job back.

Evidently if it is showing up on her criminal history, she's been charged and it is probably pending a court date. She needs to get her hands on the video tape, which is going to be hard if she no longer works for them. Tell her not to plead guilty to anything, nor take a lesser charge. If she pleads guilty, she will carry those charges the rest of her life and with her being in the field of work that she's in, she will never get a job. Best to go to the court house that the charges are filed in and find out what is going on.

If she knows for a fact (saw it on the video) who took the wallet she should report it to the police and fire the person. Sounds harsh, but if she doesn't she will be held responsible. And if anything else gets taken in the store and it is found the same person took it, she will be responsible for that too. She must take action now to save her own but.

If she doesn't know who took it, she should still report it to the police and tell them it was concealed in a paper bag, so no one knew what it was and she is not sure what happened to it. If there was a procedure in place for items left behind the shift manger should be disciplined if there was no procedure it is the fault of the manger.

If this happens again, she should lock the wallet in her office so it does not get stolen. She should meet with all the employees and let them know the new procedure and that anyone who steals will be terminated immediately. She should document the meeting to prove she has done something to stop the behavior. The store manger is ultimately responsible for every shift weather they are there or not, but the shift manager is also responsible.

If she switched jobs that changes everything I said. All she needs to do now is go to court and prove her innocents. The tape should be viewed (she may need a lawyer to help her). She can not be held criminally responsible for what other people did at the store.

The manager who was in charge on the 2nd shift should be the one responsible. She wasn't even there, what can she do? Anyway, this was in august, so how is it an issue now? the lady is just now coming back for her wallet?

give the security tape to the police and have the suspected employees interviewed by the police. Additionally, any involded with the theft should be fired.

Get a lawyer and sort yourselves. She's fine. Nothing was done illegally on her part. She'll win. Trust me. Make sure the lawyer gets that same information, and you're gold.
