You don't have to be a legal resident or citizen of the US to get a marriage license. However you do need valid id, whether it be a passport or driver's license etc... Whatever state you live in will be able to give you a list of acceptable documentation in order to get a license.

In case you're wondering, the poster that said Las Vegas is wrong. You still need acceptable forms of id to get married there.
