How do I find out how much I will get?
Does my employer have to pay this?

Your employer is not required to pay Maternity leave - some companies have a program, most don't. The leave below is paid by the state of California and not by your employer.

There are three kinds of leave that will apply to you for maternity in California. It was really confusing to me to figure out when I went on my own maternity leave.

1) The Federal Family Leave Act (FMLA). This protects your job for a period of 12 weeks during a calendar year for the birth of a child or to care for a sick relative, and is also available to the father.

2) California Disability. This pays a portion of your salary (up to a maximum) for a period of six weeks or longer if you have complications (like a C-section).

Note that there is a 5 day waiting period before the leave kicks in. Your employer may require you to use your vacation/sick time to cover these five days. The leave is paid by the state, not your employer. Your doctor cannot certify you as disabled until after this waiting period. Have the form all filled out and give it to your doctor when you deliver OR earlier if you are leaving work sooner.

3) The California Paid Family Leave program, which pays for six weeks of leave that starts after your disability runs out. THE FATHER ALSO GETS THIS LEAVE.

What is boils down to is this: for a regular pregnancy, you get 12 weeks of your partial salary, and your job is protected for those same 12 weeks. Note that if you go out on leave prior to delivering, the 12 weeks starts then.

I just filed.I never found out how much I will get but I filed online and printed the rest out for my doctor to fill out.And he sent it in.

Hopefully this will take you to the page that says "Disability Insurance". You can then file right there or click the Blue "Online" link and do your part and print when it gets to the doctors page.Hope it helps.

You should be filing through your work so talk to your employer about it, they can tell you how much if anything you will get. And you should be able to get the forms through work.
