I living with two other people and my roommate has a random person living in her room who has not subleased from her and she is not paying rent. it states in the lease that someone leaving illegally that my roommate could get evicted. can you sue that person living in our apartment who is not on the lease?

The rights of landlords and tenants are dependant upon country, region, state and city/town that you live. If in the U.S. I'd suggest going to google and finding the Attorney Generals website for your state, there you should find information surrounding your rights as a tenant. Myself as a landlord has had situations like yours and for a landlord I would have to go through legal processes to evict the tenant, because in Maine where I live after 4 nights of consecutive stay, a guest becomes a legal tenant.

Usually the leasor stipulates how many people are allowed to live there. If it is found there is someone living there illegally, it is up to the tenants to remedy that before it becomes a problem. You would have to bring it to the attention of the person allowing the illegal person living there to have that person leave before going to the leasor.

RH is right on the money, it's totally dependent on your jurisdiction. It's possible the police may remove her if she's not a registered tenant, but it's equally possible you'll have to go through legal channels to have her removed.
