i left a shopping bag in a different store but when i went back to get it they said they had it but couldnt find it so could i come back in 30mins when i did the 2 managers were on the floor and the lady i spoke to was out back.they said they had been mistaken and started telling a serious of what i believe to be lies to get out of the situation.what are my rights in this situation if i have any at all?

i left a debenhams carrier bag with a box inside in a faith shop,i went into the faith shop & the girl said yes i know i saw it boxing day & started to search for it frantically,she kept looking round & i kept saying a debenhams bag witha box in it and she kept saying yes it was here i just need to find it.another assistant came over and the manager and they all knew what i was on about and were looking for it they said it must have slipped down the back of the counter,could i come back in 30min.when i returned the lady that had seen it was out back & 2 managers were waiting at the counter i said had they found it they said no we were mistaken it was an m&S bag left yesterday and its been returned,i said well it cant have been that one as the girl found it boxing day oh well if you want to leave your name and number.i then spoke to the girl who brought out a handbag and said she though i meant this1 even though it was not at all similar and would not have fitted behind the counter.help

Get the names of the people you spoke to initially (who said they had it) and write/phone the store telling them who said what.

Establish the value of the bag and how much compensation you would accept before you contact them.

Be persisitent - don't give up or be fobbed off

Keep going up the corporate ladder. The store manager might not be enough. If you know of a community figure who can vouch for your integrity, you might want that person to give you a letter that you can show to the upper management. Legally however, it is hard to prove unless you ask for a copy of the video tape (if it was caught on tape) that you left the bag and then either somebody else picked it up or the store took it back.

For info, my aunt did this when a valuable silverware was not given to her (the bag was not given to her, she did not forget it). However, she did go to upper management and had someone of authority vouch for her. I think the manager of the store was moved to another location as a result and she did finally get the silverware.

Once you paid for the products and took possession of the bags, it became your property and, therefore, Your responsibility to look after your own things. Once mislaid, any random passerby could have/probably did take possession of whatever it was that used to belong to you... (not the store's fault.)

Stores are constantly scammed by people who "find" discarded receipts, walk into the store, and demand "replacements" for items they claim they bought but were not "in the bag" Stores like WalMart have had to maintain detailed return records to identify likely scam artists.

The person that asked you to come back in 30 minutes was probably trying to "pass the buck" to a higher manager, but was out of line and in violation of that store's policy. That would explain why she was "in back" where she could do no more damage and a more experienced manager dealt with you later on.

Why should one store pay to replace things you "claim" you bought elsewhere and "lost" there? Why should they even believe your story? You have to admit the story would sound fishy to any one

This is difficult. It is your word against theirs basically. If the managers wouldn't take you seriously, i can't see what else you can do. Even if you complain to the highest level, if they say that they thought they had your bag and that they were mistaken, what can you do? Unfortunately it is your fault for losing it in the first place. Try keeping calm and ask the cupboards and stores etc to be searched again.

Wow, this happened to me last week, i too was told they had it but couldn't find it. When i returned, i was told they made a mistake. My sister works for Citizens Advice and she rang around for me. Unfortunately there is nothing that can be done as there is no proof they genuinely made a mistake. You could ask the lady if you see her by herself maybe? Other than that, i can't think of anything. Good luck anyway.

If they have CCTV cameras in the shop then they can find out what really happened, sounds like somebody decided to keep the bag hoping no one would claim it, kick up a fuss until they "find" it

Don't wait get the "Police". This happened to me and I got the police but they'd destroyed to CCTV tape. (I made the mistake of telling them I was going to get the Police). Just go to the pOlice and they'll get the tape and hopefully bang up the thieving ******* for the long haul !!!!!

If you had I.D. in the bag, & also on you, couldn't you prove it was yours that way? They have no right to hold on to your things, & should return them to you immediately.
