Should Probate Court appoint a Guardian and/or Conservator for a minor, prior to commencement and procesecution of the minor's claims.

Theoretically? yes. The thing is, most adults don't know how to navigate the legal system, so who could expect a minor to do the same? Requiring minors to have either a guardian or parent to bring the claim means that at least one person who is old enough to be accountable, and old enough to exercise reasonable legal judgment, is a party.
