on November 28 of 2006 my 4 children ages 5 years,4 years,2 years & 9 months were takin by child youth & family services.the reason of why they were takin is not making any sence accourding to my lawyer but nothin can be done until January 2007 when the courts open.i have gotten letters from daycare,school staff,doctors,landlords & a number of others that are willing to take the stand on my behalf & are behind me & the children 100% & are 'pissed off' about what has happened.also,since the children have been in the care of CYFS their are concerns of their health & well being,the doctor & the daycare have the most concern.my 9 month old has lost weight,have had marks on his back,& others concerns since the childern hace been in CYFS care.their is not enough space to tell you everything that has happened but i can tell you that for the past year one worker has caused a great amount of stress to my family & now i'm worried about the children,they are acting out,i only see them 3x a week.

I am so sorry to hear what you are going through. I do not have details of what type of investigation that you are going through so unfortunately my advice will be a bit general.

I work for the system but each state is different. We try to work with families to put supports in place so that a child can stay with their families. It's always about the best interest of the child and it is usually in the childs best interest (unless there is clear abuse and no way to asure saftey) for the child to be with their family.

It seems like you have a good lawyer and plenty of character witnesses. If you have a problem with a particular worker, speak to the supervisor of that worker or have your lawyer come up with ways to approach CFYS and demand that they change the worker for your particular case.

Once you and your lawyer have gotten the children safely home, you might discuss with the district attorney whether there is cause to charge malfeasance or misfeasance on the part of CYFS for which you could sue.

But until you get the children safely back in your own custody, and the judge has said that is where they belong, you would do well to be very polite and patient and very, very persistent. Quietly, with dignity, insist that you will not let the matter drop until your children are home.

If there was no just reason for your children to be taken, why did your lawyer not request a 'show cause' hearing at your first court appearance? CYFS is obligated to bring an application to court within a few days of removing children from their caregivers and then it is up to a judge to decide if the children remain in care or are returned. If you have issues with your worker, there is a complaints procedure to follow, which includes talking with the worker's supervisor and then director of services for that agency if you are not satisfied with the outcome.

I am soo sorry to hear this, and yes I totally agree that the whole system has been given way too much power. I get so angry when I think about them taking kids from there parents. In some cases, intervention is needed, but most cases there is no need for it. I have not had my kids taken away thank God but I have been in situations where it could have happened. Good Luck and we should really look into this and see what we can do as parents to fight it.

Yep.... very much so. So much so that we were liscenced to foster adopt a baby and they were trying to make us take a child we didnt want and would not listen to who we WERE willing to take!!

Further, anyone can make a call or an accusation and they can come and take your kids immediately.

Its gastopo germany folks............its wrong. So very wrong and those people will be accountable one day. I assure you they will answer to God for taking kids from their parents.

It is NOT the Govts place to tell you HOW to raise your kids period!!! I know of folks who home schooled and got their kids taken away for it. The GOVT has NO right to tell you what or how to teach your kids.

Its bad here................its super bad. Its only becuase people have gotten lazy and let the Govt run our everything! they are involved in every aspects of our lives. If you think about every dept of everything...........we are a mass who is very much controlled and we say we are free?? my ***!!!

All government agencies should be subject to higher authorities.

Is there no agency that can help you to review your case?

it is a failed system. people don;t care as long as they don't pay more taxes.
db. government agencies should answer to the people.
