How do you become emancipated?

I'm 15 and I live in VA..Do you need a lawyer?

You have to be at least 16 to petition for emancipation in VA. You’d have to prove to the court that you are capable of fully supporting yourself—paying for rent, utilities, food, medical expenses, etc—with NO assistance from anyone. And the judge will want to see that you can do this while remaining in school. In addition, you have to provide a VALID reason that emancipation would be in your best interest. Reasons such as not getting along with your parents, not liking their rules, wanting more freedom, etc aren’t valid reasons. The court can require other things as well, and they can deny emancipation for any reason that they see fit, including, but not limited to, their belief that you lack the maturity to function as an adult. Emancipation is RARELY granted in any state.

if thats what your talking about, and that your 15, the ONLY way for you to be emancipated is to have your parents sign paperwork to that extent, and/or, have the local magistrate find your parents unable to provide and care for you, inwhich case you will be put into a foster home, since your 15.

I would HIGHLY suggest waiting until you are 18 (or whatever your state law provides) and go out on your own.

In short, you cannot be until you are a legal adult. That does not happen until age 18. sorry, but that's how th law works right now. contact your elected officials if you want it changed.
