I worked Xmas but got paid straight time. Somebody told me this was illegal, but, I'm PT, so I don't know. This was in West Va. and it happened to the other PT people, too.

My quick online review of WV labor law suggests that there's no legal obligation to pay an overtime wage for holidays. More liberal states often have such laws.

That said, if you're working for a decent-sized, multi-state corporation, there's a very good chance that the company has an overtime pay policy for holidays worked. You should check into it. If they're violating their own policies, bring it to your manager's attention. You can also file a complaint with your state Attorney General's Office at that point for the company's failure to pay the wages specified in your contract (usu. a form with a title like "Non-Payment of Wages").

Christmas, although recognized as a holiday, is more based around religion. So not everyone celebrates it (although about 75% of Americans do). I think it varies with each company. Like others have said, email your company or talk to corporate about it. Or better yet, ask your manager.

Like another person said, if you are a newer employee, you may not have that advantage. I have been working at a retail store for 2 1/2 yrs and I get paid 5 hrs for Christmas w/o even working, and I am PT. So I think you may have to be there for a while before you can take advantage of time and a half, paid vacations, etc... But again, it depends on the company...

No, it is not illegal. Since almost all jobs are "at-will" they do not have to pay anything but what you are contracted to make. If for some reason a company wants to pay you time and half for holiday pay it is on their own merit and nothing else.

Usually an employee does not get holiday pay or time off until they have worked a certian amount of time for a company, sometimes 3 months, sometimes 6 months. It all depends on the company too. When you are hired you have inquire about this or check your employee handbook (if you have one). This is the case for most NON-GOVERNMENT jobs.

If you work for the government doing anything at all, you are usually off on any given national holiday. If for some reason you are not, then it is expected they pay you compensation for it.

It depends on the company. Where I work, you get time and a half or "holiday pay" for like six holidays a year, but my boyfriend works for the state, and he doesn't get it. Don't be afraid to ask about the company policy.

It's legal unless your company has a special deal for it. Time and a half is for overtime, over a certain number of hours per week.

You should check the company's pay policy. Don't be lazy or afraid to do it. It's your right.
