We are living on land that belongs to a woman that lives directly across from us and have been living on it for the past 17/18 years. Now, they want us to move and 3 months have passed since they informed us of their decision. We have not been able to find a place to live yet, and is it true that you cannot be forced to move if you have no place to go? We also have not been able to find a place because my parents have credit problems and can't find a place to give them the loan, so that is why have haven't been able to get off her land.

you did not tell us the manner in which you got informed to vacate.

most states require that even if you are a month to month tenant, the owner has to send you, via certified or registered mail, a 30 day notice that tells you that you must be off the land within 30 days of the date of her letter. now, she may give an extra 5 days for mailing, which a judge would see as reasonable.

i have no idea what loan you mean. why would you and your parents need a LOAN to move? do you mean a loan to purchase a place? i think you will have to attend to that later.

there are no laws that state that just because you cannot find another place to live that you are allowed to occupy someone else's property. since she doesn't want you there, be happy you have not yet been evicted, but it will happen. get another place to live and leave.

To answer your question, "is it true that you cannot be forced to move if you have no place to go?", the answer is No. If the landlord wants you off their property, one way or another, you will not be living there. Either you moving on your own, or the landlord can take you to court and evict you.

Since the landlord gave you notice 3 months ago, she can start eviction proceedings against you at anytime.

Also if you've been renting from her, why all of a sudden do your parents need a loan? You don't need a loan to rent.

Check to see what the law in your area is concerning a situation like this. There must be a limit on how long you can occupy someones property if the owner wants you to leave. Does the woman want you off her land because you are not paying rent like your supposed to be?

Just because you can't afford another place is no reason to stay on that woman's property.

Be thankful she has not served you eviction notices. Keep trying diligently to find a new place.
