My husband is applying for a job at a bank and in the application it says that they perform a background check through the FBI. When he was younger (16), he got in trouble in a different state and got a misdemeanor on his juvenile record, which is now presumably sealed. Is this going to show up on this background check? He has never had an issue with it before when applying for other jobs, but we figured the bank would do a more thorough check.

I work at a bank, but I don't know how thorough the background check is. (I don't have anything other than a bad driving record when I was younger.) I do know the FBI can get their hands on any records that still exists if they want to. That includes records that only exist in the memory of the officers involved. That said, I doubt 1 juvenile misdemeanor will be a problem even if they find it. Just don't lie about it.

Lori K: They do extensive interviews for national security clearances. For a bank, its basically a computer records search. The don't have time to interview kindergarten teachers for every bank employee in the country.

If the conviction was as a juvenile and expunged (ie. removed from his criminal history) then it will not show up on a criminal background check. If the FBI is basing their background check on NCIC (National Crime Information Center) records, then the juvenile conviction will not show up. However, since you are talking about the FBI, they may find out about the conviction simply by checking court records in the areas that he has lived or talking to friends, relatives, prior employers. The FBI does an indepth background check. They will go around and interview friends, neighbors and relatives. It's very likely to come out, but not from a criminal background check---rather from his family. Lots of things seem to show up in these interviews.

Definitely DO NOT LIE! A juvenile record probably won't be held against him much (as long as his adult record is clean), but lying on the application is definitely grounds to reject.

No juvenille records do not show up on the NCIC report, there is no true FBI background check, the FBI check is only on your fingerprints to prove who you are, then they do a criminal background search

Now of course if they interview friends of yours that you listed as a reference, if one of them knows and says something it will turn up,

but Juvenille records are sealed

I'm pretty sure offenses as a minor can't legally be used against you.

Also, credit checks and background checks are two toally different things.

Also, the FBI doesn't run any banks and I doubt they are used to do background checks for employment purposes... are you sure you didn't just hear some one say "The Fed." and you assumed it was the FBI?

"The Fed." is a term used for The Federal Reserve Bank in financial circles...

Yes. They will check, will find it, and no records are sealed. If there is a record, it is able to be accessed.
