I have to have a surgery with a recovery time less than one week in the hospital. I got a jury duty notification with the court date the same time I will be in the hospital. It's not an elective surgery, but it's not so critical that I won't be able to move it back a couple of weeks if I have to. I would like to get it over with, though. I have never been summoned for jury duty before. Any help would be great.

I work for a doctor and we write the court clerk all the time saying due to a medical condition the patient needs to be excused from serving on the jury at this time......then the patient, you in this case, takes it to the clerks office, they don't have to know the exact details..the doctor has provided the evidence that you can't serve.

Absolutely not. Write a letter to the clerk of the court that issued the summons and state that you have surgery scheduled at such and such hospital during that time and will be unable to comply with the summons. This happens all the time and you probably won't hear another thing about it. Send the letter ASAP so that it arrives BEFORE you are due to appear. Keep a copy for your files.

Simply notify the court and they will excuse you. I had my jury duty postponed because I was going on a trip to Hawaii, I am sure surgery will count!

HI TOOGERQ,
I was summoned to jury duty and i sent the paper back to the court with an explanation saying that i was severely disabled and that it would be a hardship on my family and i if i was to appear for jury duty..........and i haven't heard from them since.....so if you do not want jury duty then go for it......

I suspect you'll be able to get out of jury duty for the surgery. You need to find out how to let the system know of your status, but I don't think you'll have any problems.

It is hard to say, it depends on the Judge. I faced a similar situation in Amarillo County Texas. I was scheduled to have an elected surgery the next day. I went in expecting a hassle and they just let me go. Just go to the ccourthouse and find out.

Just let the court know that you have a scheduled surgery. I'm sure you could even get the doctors office to write a note so they know you are not making it up. But do not just not show up, that'll just cause you more trouble.

No sweat. A simple note from your doctor that you will be hospitalized is good enough. The jury service people will just recycle your name and you will be called again in the future.

Notify the court that you have surgery. They will postpone it for another date and send you out another notice when you are needed again. The sooner that you do it the better.

Most every jurisdiction will allow you one continuance on your service as a matter of course. call the Jury Commissioner's office and tell them what is going on. They won't make you show on that day. But make sure and tell them. You can't just not show up.
