My friend has been living at my house for the past 2 years. I want to ask him to move out. He acts like he owns the house and is letting me stay here.He has a child who lives primarily with the mother. I agreed that his son, 8, could stay here every other weekend.He brought his son up for the entire week this week and didnt even ask me first. The house is really too small for this, and the child can be quite rude.He plays loud music when I am trying to study, has weird friends,and does not pull his weight financially. Do I have to formally evict him? Does it make a difference that I own the house and live here also? Will it take months to get him out of here? I have tried talking to him about this stuff, things improve temporarily, then go back to where they were

Make sure you write down the specific terms of this agreement and have him sign it. For future reference, always put agreements concerning living arrangements in writing and have both parties sign the agreement. It doesn't have to be a formal lease just make sure everyone is clear about what the arrangement are. If circumstances change pull out the agreement and revise it. Have an exit strategy in case things don't work out.

Regardless if he pays or not, he has established residency and you must evict him through the courts. If you have a financial arrangement (i.e. rent), then you are a landlord and without a lease (month to month tenancy), you must give him 30 days notice. You can also file for eviction at the same time so you won't have to wait 30 days to see if he really leaves. If he doesn't, you've already started eviction proceedings.

If there is no rent agreement, then he is just a roommate, and the 30 day rule still applies. The difference between lease and no lease is that you don't need cause to evict a no lease tenant. You can evict him for no reason at all.

That really stinks...but I think that the sooner you get him out, the easier it will be. Tell him the truth...at least partially. Tell him you don't like how he's taking over and that you really want the house to yourself so that you can lead a quieter and more productive life. Give him 4-6 weeks notice. I think that's fair!

I think that depends on where you live. I do believe that here in CA, you'd have to go through an eviction if he's been there more than a month. Even if he's not paying rent.

Do you have a written agreement with him? If there is an agreement, you must refer to it. Eviction times usually depend on the lease period, year-to-year, month-to-month, etc. If you don;t have a written agreement and especially if he doesn't pay you, there is no consideration and you owe him nothing.
