Can't fake a death -- she broke the contract, and since she signed it, she is responsible for her part. If you BOTH signed the contract, then it is up to the gym to get her to pay her part. If you alone signed the contract, and were going to "share" the contract, then you will have to get the money from her. If it is the first case, I would give the gym her contact information, and I would suggest that you continue to make your own payments. Bad payment schedules go on your credit report and it takes YEARS to erase -- we cosigned for a friend to buy a car, and she missed a lot of payments (extremely late in many cases), and the bank never notified us that she was deliquent so we could have at least kept the payments on time -- she has since paid the car off, but all of our credit reports still brings this up as "extremely deliquent" on this particular purchase. This makes it hard to make any other big purchases or refinicing of house, etc. Don't risk it.

Probably not a good idea. If the company finds out that you've lied about something like that in dealing w/ a legal contract, they could sue you. If both your names are on it and she's stopped paying, you're still liable for the whole contract. Don't take a chance on it ruining your credit. You can take her to small claims court and if you win, the judge can order her to pay for the court costs too.

They would probably want to see the death certificate. You should call them and see where you stand. If you stop making payments it will hurt your credit. Best to call them. Maybe they can help you figure something out. Maybe your (ex)friend will agree to sign off on the contract.
Find out what's needed first but it sounds like you're stuck.

Believe me.. if you lie, you will be caught. I see this on Judge Judy and all .. all the time.. She must NOT be a friend of yours if she would do something like that NO MATTER what her excuse is.. Inform the gym and see what they say and if THEY(not you) can make her pay... If not, then you would either have to a) pay her half thru the end of the third year; or b) sue her

They would take her off the contract once you produce a death certificate verifying her death. I would take her to small claims court to have her pay her part.

Probably not and even if they did, once it is discovered you can be charged with fraud or theft by deception. What would you rather, pay her amount or get a record with possible jail time?

You are the one that is stuck--everything these days are set up by social security numbers. All they would have to do is check activity with her social security number. If she is still working, she can not be died.

see where you stand with the gym, and if they can sort it out for you, if not then take legal preceedings to get her to pay her bit.
