I have worked for this family for 5 years, and finally quit on Christmas Day. My boss will not take my phone calls and says to put it in writing. She still hasn't answered any of my emails, and I am a college student who needs money. I would rather do this without hiring a lawyer, but don't know what my next step will be. HELP!

The Fair Labor Standards Act requires that domestic help (which includes nannies) be paid at least the minimum wage of $5.15 per hour for all the hours you have worked. Contact the Wage and Hour Division of the US Department of Labor at 1-866-4US-WAGE or online at www.dol.gov - they have investigators there that will call your employer for you and negotiate payment of your final paycheck. If you have no contract then you are free to quit at any time and be paid for what you did. I would not say that is the right thing to do, but it is legal.

Your employer is required to pay Social Security on your income (as are you along with income taxes) If that has not happened, then you certainly have some leverage.

I suggest a letter (return receipt requested) clearly outlining the amount due and an expected payment date. DO NOT threaten in the first letter. Just ask for the money in a professional manner. If payment is not made in the time indicated, a second letter indicating that you will be contacting the IRS about the failure to pay FICA should get their attention. Never threaten, just state the facts and only say what you intend to actually do.

Ask your local Labor Commissioner's Office (411). You might be able to file a complaint.
