I should be allowed access to my soon email being he is a minor and passed away in July 2006. I gave them what they wanted a death cretificate and now want me to get a court order! Who is gonna pay for that I am a Mother of 7 children??

It may not seem fair, but what purpose would having access to the account serve? Do you really think there is something in those emails of value? Even of interest? You might find out things you don't want to know.

You will need a court order. And given the limited amount of time that unused accounts are kept open, there may be nothing to get.

Strange. For starters, why do you want access to his E-mail? Do you suspect there's something in there that might indicate why or how he passed away? Secondly, I can understand that Yahoo may have a liability issue and may want to protect themselves from being sued by you, but I can't see how they would be liable so it doesn't benefit them to require a court order. Now, if there are "suspicious circumstances" surrounding your son's death, you may be able to get the police to help you. The investigating officer can get a court order for access to your son's E-mail in that case.

It's going to take an act of congress to get that password. I've had family members that have died, and Yahoo! would not give up the password, and kept adding to the list of things that they would need in order to give up the password. Family members also had Myspace, and it was the same way with them. It can be done, but like I said, it's not going to be easy.

If it has been that long his account will be on hold awaiting someone to reaccess it. There will be no emails in it as they would have been deleted.
Yahoo! will hold the user/account name for the original user but that is all. All of the folders will be empty if there hasn't been a log-in in 3 months or so?
