Depends on who cheated. But you'll be away from the one who cheated on you or vice versa, and then able to get on with a meaningful life and relationship elsewhere. If Kids are involved..then no one wins and there are few benefits. But its better for the kids to see ya'll apart and happy then together and miserable.

There are really no benefits in any divorce except for the part about getting out of a marriage that can't be "worked out". Adultery has no better "benefit" in divorce than mental/physical abuse, alcoholism/drug abuse, child molestation or any other reason. The most important thing to think about are the children (if you have kids) and the way a divorce will affect them. Both parties must think of the kids welfare before themselves. Good Luck!

As I understand it (although this understanding is based on Canadian law), the main benefit to filing for divorce for adultery as opposed to irreconcilable differences is that you can have it completed faster. Here, you have to have been living apart for a year before a divorce can be granted for "marriage breakdown." There isn't a waiting period if one of the parties alleges adultery (or abuse, etc.), but it's harder to prove unless the other preson admits to it.

If there are children involved, a charge of adultery may also impact custody and/or alimony payments.
