I received a check from an ebayer for $206 I shipped the items after a week butthen the check was returned because the account was closed. After some digging I found out this buyer has done this to more than just me. Is there anything that we can do to get our money back? Their account is closed on ebay, email is closed, phoen number disconnected. What now? Plus they live on teh otehr side of the country. Can I file in my state and make them pay court fees? Should I just take it as a loss what do i do? I live in CA HELP PLEASE!?!?

Since you didn't use PayPal, I don't believe ebay will do anything other than close their account. You say that's already been done.

I've listed these in the order that I would do them if it were me.

Since you live in CA and that's where ebay's located, you may be able to file a claim in small claims court. Call your local court and ask them. You're in luck in that respect - if you lived in any other state, the court might tell you that you have to file in CA since ebay's there and the transaction took place on their web site.

Try the post office, assuming they mailed you the check. That's mail fraud and a Federal offense.

Check their state's web site. The Attorney General page may have something. Writing a bad check is a crime in most states, if not all.

Check with your bank. They may have a few suggestions.

Some of these may be a long shot, but it won't cost you any money to look into it, just a little time.

I would file charges for that amount and yes you can ask for court fees. There is nothing Ebay can really do and that is why I keep telling my husband never to take checks off of Ebay and sadly Paypal makes it easy for the buyer to get their money back once they get the item as well.

I agree with the 'lessons learned'.

Next time make sure you wait till it is cleared in your account. Put a notice in your auction that "any personal checks will have a four week waiting period to ensure it clears before any item is shipped". Then after four weeks ship the item.

OR, don't allow personal checks. Only allow money orders or cashiers checks.

Unfortunately, you'll just have to chalk up up as a learning lesson. Next time you accept a check (something I wouldn't recommend on ebay... paypal at least offers SOME semblance of protection) wait at leat 10 days and check with the bank to make sure it cleared.

You can report the person to eBay however eBay is going to tell you the same thing I am, there are eBay sanctioned forms of payment. IE Paypal. Use them. They are there for you protection. You can also file a police report since it is fraud. In the future be more careful.

well you can report it to the police and email ebay saying what he did , they will shut down his account , also i would call the mail company you used to send the item and try to get it back
