On my W-2, right now I report as married. Do I need to change this now to Single or until I get the court papers saying I am divorced?

Its up to you, if you were married for more than half the year then it won't matter. but if you get divoriced in say january you'll want it changed as soon as possible. I'd change it now. They really don't care, it just changes how much tax they take out. I am married with two children and I have always clamied single with no dependants. I get whatever extra a pay at the beginging of the year and NEVER have to worry about paying when I file my taxes.

Change it when you are legally divorced. However according to the IRS if you divorce before Dec 31 of any year, the next years filing you will be considered single, even if you were married 364 days of the tax year. I am waiting until January to finalize my own divorce just to avoid paying in on taxes next year... Legally your status does not change until you hear it from the court though.

since you filed for a divorce you can file separated but you can not file single until you get the divorce and if you still live together or if you are still using the same addr you can not file head of household either witch will loose you some of you Earned income credits so you may wanna still file with her until divorce is final or file separated not single there is a diff

wait until your divorce is final. Your filing status can be married but filing seperately. After the divirce is final change your status with your employer to single so you wont have too little taxes cut from your payroll.

Wait until your divorce is final,. That W2 form when is sent in has both names and whoever gets has to get the other to sign the return check and give half to their spouse, if you owe them, you have to pay half of that monery. Because the W2 and check has to be signed by both parties. Best thing for you to is call H&R Block and tell them the circumstances and they'll tell you what is the right thing to do.

wait until the divorce is final. It's actually saving you money by showing married. the percent rate goes up for single.

The first year we were separated we filed joint since we were together most of the year. We then split the return. The following year and since then I have filed Head of Household.

When in doubt call up H & R Block and ask them...

Since you did not provide enough info on how long you have been apart, etc. you can take the marital status test. It's pretty simple. You answer a few questions about the marriage and it will tell you what your marital status should be.
