i financed my car through wells fargo we have never been late on any payment we pay whats on the bill. we had insurance on the car since we had it and sent them what they needed so they dont tac on there insurance. well we switched cpmanys in october and sent them what they needed. onn december first they decided to tac on insurence even though we haveit. i did a three way call with wells fargo and my insurance company and they got everything that they needed. well they call over three times aday witch by the way is considered harrassment in my state i havve told them to stop calling bwecause they wont talk to even though they have my power of attorny and my husbabnd has called and told them they can talk to me. iu sent the poa 7 times. they claim that htey have nothing logged in the computer about that. some of them talk to me others dont. what do i do

Who is the car in the name of???? You or your husband???? Who ever the car is in the name of, is who needs to get on the phone and when they call, that person should immediately ask to speak to a Supervisor on duty.

Let the supervisor know how many calls you have received and the dates and the names of the individuals and be assertive in your conversation with them. Let them know that this is the last time that you want to have this conversation with them and before you end the conversation make sure that there is a clear understanding that the matter has been resolved and that you wish to receive no further calls.

Recap your understanding of the conversation and ask if it will be necessary for additional follow up on your end, meaning that you do not want them to call you, but you will check in with them.

Compose a letter to your state's attorney general and send a copy to your state's director of insurance and tell them everything that has happened in detail. No offense intended, but use spell-check. Also, put everything you have said in writing and send it to Wells Fargo and the insurance company. Also, try calling your state bar office and getting a referral to a consumer protection atty. My state gives free 1/2 consultations with attys. This problem could easily by solved by a letter from an atty. Since I don't know where you are, I can't tell you how much that would cost. If you're low-income, it could be free. If not it should be about $150-200 for help from an attorney. If you are harassed by a collection agency, you may be entitled to all your atty fees and triple damages. You can also require an amendment to any negatives on your credit report resulting from this abuse of the Fair Debt Collections Practices Act. However, some of this is state-specific, but most of the protections are in federal law.

Make a copy of all the payments you have made, and the bills you have received, and go to the company (office) and show the the payments you sent. After that if they continue to call switch to a different company. If they STILL continue to call. Press charges. Because if you're spending all this money, there should be no way in hell you should be getting phone calls. I'm a collage student, and i work with renting company's, and if someone hasn't paid a bill, then we call 2 times every other day. Before you take action, make sure that EVERY bill is paid! Are you sure you're not missing one? If someone shows up in our office with copies of payments, and bills, that they have paid, we put it in our computer, and save it so there is no problem. Sometimes that won't always work because you may be missing a bill. Good Luck!

Keep after them. If you have the necessary insurance, there should be no problem. If they continue to harrass you, ask to speak to someone higher, as in a supervisor. Your insurance agent may be able to help you sort the problem out. Another option is to go to the Wells Fargo Bank and ask to speak to the manager or loan officer. Sometimes things are better handled face to face. Bring documentation with you.

Next time they call refuse to speak to whoever is calling you and instead request to speak to a supervisor. When you get to the supervisor explain the situation and remind them of the harrassment laws of your state and that if the issue cannot be resolved TODAY on THIS CALL, you will be speaking to your lawyer (say it even if you don't have one, it usually always scares them into getting their butts into gear to fix the error on their end). Remember the person calling you probably knows nothing of your story and is most likely sitting there reading a script in front of them. Get the supervisors identifying info (name, employee #, etc) so you can request to speak to them during any future calls to avoid retelling your story over and over.

Here is what you do,
send all your copies of insurance current an validated REGISTERED mail to them., along with a well thought out letter to explain the situation. Don't be an asz to them, kill them with kindness. Remember these days your probably talking to someone in India on the phone.
Or re finance it some place else.

Mistake #1 Wells Fargo

they are vultures as you are finding out.
They put you on a call list and Wells Fargo Dogs from all over the US, india and wherever else, call you until the name is off the list and it doesn't matter what or who you have talked to.

GET A LAWYER ON THIS AND HAVE IT STOPPED IMMEDIATELY OR THEY WILL PUT IT ON YOUR CREDIT REPORT AND IT WILL TAKE FOREVER TO GET IT OFF.

call your lawyer and get some legal advice from him because if this realy harassment in your state you can make money off of this.....other than that get you lawyer on the phone next time you talk to them.
