we have been seperated for 10 years,we married in the caribean and i dont know where my ex is now and i dont have the marriage certificate

I'm in a similar situation, but only been seperated 3 years, to file for divorce without your spouse's consent you need to be seperated 5 years, or file under abandonment, however both options require the marriage certificate. I would say your best bet is to contact the court house or similar government office to obtain a copy of your marriage certificate. Once you have that you can obtain all the documents you need to send to the court for a divorce off the internet, and only have to pay for court costs without needing a laywer (and all their outrageous fees).

You can easily obtain a copy of the marriage certificate from the country that you were married in - a fee will probably apply. In the UK you need to be seperated for two years with both parties consenting or five years without one consenting so you are well within the legal time scale to apply for a divorce without your ex's consent but you will need a copy of the marriage certificate.

Same situation here. Cant get a divorce without a marriage certificate. Jamaica? I can tell you how to get a copy of the certificate. Other island? May be similar. Find the country's official government website using a search engine. Look up registry department or official documents. You may be able to retrieve it online. I did. Good luck. x

ok theres a thing that says, if there is an absence of one person from a relationship for a certain time period then the marriage can be dissolved. see a solicitor, they do £5 for 30 mins in some places to give you advice.
you will need to locate a marriage certificate. contact the place that married you for help if you get a sol,icitor to do this it will cost a fortune, do some of the leg work yourself to save money. good luck

Out of sight out of mind!! Communicating with the officials of the Births, marriages and deaths Office in that country (abroad) to give you a copy of the certificate will take ages and may not materialize. Check on the stance of your country's laws on this subject so as to annul the marriage and set you free to re-marry.

The State will recognize your foreign marriage if 3 things are in place:

1- you ever held each other out as married (introduced the other as wife or husband)

2- you shared bank accounts

3- you lived together

It doesn't matter if he is gone, you can still apply for a divorce and testify that you don't know where he is. As a matter of fact, it happens all the time...go visit a court room sometime (civil docket). It's amazing how many dead beat dads/husbands there are out there.

I would suggest speaking to the British embassy in the Caribbean, they should be able to tell you who to contact in the country to get a copy of the marriage certificate.

Also you should speak to the citizens advice. I think there is a clause when you get married that if you are separated for a certain amount of time your marriage can be nulled.

If you know the exact day of the marriage you will find that if you call that country and find any government office they will direct you to an archive office and you can have a copy of your marriage certificate sent to you.
