He was just found guilty of sexual assualt of a child and repeated sexual assault of same child and on top of that it was a person he was related to. He has not seem our child for a few years, but i am worried that he will try to get visitation one day. Do u think they will take his record into consideration? They won't allow unsupervised visits will they? you think?

I would have to say that the court would more than likely not allow him the visit. You can petition the Family Court to terminate his parental rights, and therefore, he could never see them again. It seems to me that the attorney for the child(ren) would have sought this out when the criminal proceedings had begun. You should look into that. When he was found guilty of these crimes, the court more than generally told him he was to have no contact with these children or any children for that matter. Good luck to you and the children. Here in Alabama they will sometimes grant visitation but it is supervised only. Depending on the judge you get the supervision can be light ( family member present ) to heavy ( meeting at a police station with a policeman present ).
I am of the opinion that they should NOT be given any type of interaction with a victim unless the victim initiates it to heal. However, I am not a judge.

You best bet is to keep up with where he is and keep your child away from him or places he might just show up. If visitation is allowed you can refuse and this will put you in the position of being the defendant in court but at least you will get to tell your story again and maybe get the original visitation reversed. It also ties up things for a while to where the child can grow and get the strength the face the father and possibly have the maturity to tell the judge why they do not wish to be around this man.

All dependant upon the judge...

but you could justify your case....if the child states that he/she is having alot of emotional issues and doesn't feel safe around the father...

I don't know your case well enough....but it seems that most likely he will be given supervised visits and it would take him a substantial amount of time and money to work to get unsupervised visits...then again the justice doesn't always dispense justice.

FYI each state/county has it's own family law's you might want to seek information what your and his rights are.

Additionally, in some states such as CA it's difficult to have any parental rights terminated...You could be in some serious litigation battles that can last years.....

Have a good lawyer if he tries for visitation. They can bring his past criminal record into the court record. He won't get unsupervised visits.

The system is so stupid now a days but there is no way they should allow this man to have any visitation right with this child unless it's supervised

I think at the very most he might have supervised visits. As a convicted child molester his access to children will be strictly monitored. Your state Child Protective Services will asst you if this ever becomes an issue.

I highly doubt the court's going to allow a registered sex offender unsupervised visits.

i think he might get his right to visit his child...but that's probably because he got a lot of money to pay off this damn-good lawyer...and if he gets one...i dont think the court will allow him to have unsupervised visits...

i hope not but if hes been convicted of sexual assault of a child i hope they take that in to consideration. If you fight tooth and nail the most i could feasible see him getting is supervised visits

Unsupervised visits are unlikely. His record will most definitely be a factor.
