In India there are so many pending cases in the courts... what in your opinion is the reason behind it?

In criminal law, most attorneys try to delay trials because after a set amount of time a case can be dismissed for lack of speedy trial. This is a constitutional right and the case must be dismissed if it is infringed upon.

The most common issues that keep cases pending are conflicts with clients such as payment to the attorney, schedule conflicts between the attorney and other pending cases he/she may have in the court, vacation time, sick leave, emergency leave, having a trial take longer than expected and lack of discovery and/or evidence that the court may be waiting on.

They want (need) to get paid before completing a case. If the defendant hasn't paid, his (her) case can't get wrapped up.
