Your ipod should come with an iTunes cd, a leaflet of instructions that will help you get started, and the headphones.
For the second problem try to reupdate your ipod on another computer. Then your Ipod should start to work.
Even that if you download songs/ videos/ Photos from a windows computer, then you cant download anything from an apple computer.

The new iPods no longer come with the CD as they are constantly updating iTunes. I have an older nano and it came with the software CD. However, I just got an 80gb iPod video and it did not. Simply go to the apple site and download the program for installation. Its easy.

Nope, the iPods no longer come with the iTunes software CD. The nano comes with the earbuds, the USB cable, a dock adapter, and the quickstart guide, which is pretty worthless.
However, you can go to the apple support page for more help.

Yes you should have gotten a software CD with it! You need it to upload your music. Plus, register your ipod. Was it used when you gotten it? If so, you might want to restore the settings.

It's supposed to come with a CD...
Well go to iTunes help and learn how to customize your iPod and your iTunes
