I lost my phone in the mall and I reported the cell phone missing a few hours later. Since I have insurance on the phone and I just paid my bill in full Sprint quickly sent a replacement. Customer service told me I would not have to pay for any damages on the account. A few days later they call and say I need to pay $200+ dollars again I told them the problem and they said do not worry about it. Now Sprint says I owe $461 dollars because even though I reported the phone missing someone was still charging to my account. I feel I should not pay for this and would like to know if their is a way to counter this. Thank You your input would be greatly valued.

It so sad for your phn, but you are responsable for the charges made to your account before your report.

There are many abusive persons (I'm not telling you are) that use their phones and then report it as stolen, then they dont want to pay the use they did. That's why we should report the phn immediatly to avoid charges in the account.

I'm sorry for you, but yes. It was your foult. You should had report it immediatly.

start slowly; ignore the people who tell you to go straight to a laywer. it will cost you too much time, money, and hassle, and may be unnecessary (you can fix this yourself). start when you get your bill; it has an address where you should send your disputes. so send your dispute in writing to that address, and wait about 30 days. if your bill is now $500, your usual bill is $100, then you send them a letter saying "i dispute $400 of this bill because blah blah blah...." and meanwhile pay only $100 of this bill. also be sure to tell the police that your phone was lost/stolen if you haven't done so already. if sprint sent you out a new phone, then that means they de-activated the old one. don't jump the gun here. i know your gut tells you to do something drastic, and fast, but don't. stuff like this happens all the time. going back and forth in writing ended up saving me anywhere from $200 to $6000 at various times, and it took on the order of several months to resolve on average. (lawyers pretty much do this very same thing, and then charge you a few hundred/hour).

no matter what though, you do NOT pay the "disputed amount" under any circumstances, and you keep disputing it in writing until it's resolved.

When you call customer care, you need to ask to speak to a supervisor. I switched from Sprint over something similar. Their customer service agents are the worst. Everytime you call, you get a different answer.
If the phone was stolen, then you should not be liable for any charges from the time you reported the phone. Actually they should have shut the phone down completely not allowing any outgoing or incoming calls and given you a new phone with a new SIM card. I would have asked for a new number even though I know that is a pain in the butt.
Good Luck in your fight with them.

try and prove that you reported your phone stolen/lost BEFORE the charges were billed to you. They wont be able to argue with you on that. Then I would even go as far as to have them call the phone numbers on the bill and ask the people who answer if they know you...obviously if everyone says no, then they cant argue that either. Dont pay the bill, dont let them bully you either. You have insurance on the phone and thats what it's there for.

File a police report and mail their sorry asses a copy of that report. I'd even go as far as to call them back and say that you already reported your phone missing and remind them that the CSR said YOU WOULDN'T BE LIABLE for any calls made by 3rd parties.

Good luck, You'll need it!

File a report with the better business bureau.....They've always helped me out when my backs been against the wall.

first speak to a manager supervisor etc.insist on it before you say any more, also get the people you talk to name ,employee#,etc. very important.now you are liable for the charges up to the time you reported it missing it is there job to provide you with info itemized its there job if they want the $ ALSO MAKE SURE IT IS SOMEONE WHO CAN HELP YOU ADJUST THIS NOT JUST TAKE YOUR INFO AND HAND YOU OFF.also to these people have lots of loop holes so read the fine print on your contract and prepare for some long frustrating phone calls.

you should probably contact a lawyer and see all your options. You aren't resposible for those charges. most lawyers give free cosultations, and a lot of times if you call they will give you answers and some legal advise for free.
